1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of OptiHub ("Service"), a HubSpot marketplace application operated by BlueOshan Technologies ("Company", "we", "our", "us"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Service Description
OptiHub is a HubSpot workflow extension application that provides the following capabilities through custom workflow actions:
- Send Webhook — Send HTTP requests to external URLs with retry logic, template variables, and response mapping.
- Run Custom Code — Execute sandboxed JavaScript code within HubSpot workflows with access to encrypted secrets.
- Format Data — Perform 50+ text, number, date, JSON, and logic operations on workflow data, including custom formula evaluation.
- Hash & Encrypt — Hash, encrypt, or encode property values using algorithms including MD5, SHA-256, SHA-512, HMAC-SHA256, AES-256, and Base64.
3. Account Registration and Authentication
To use OptiHub, you must create an account using one of the following methods:
- Email OTP Verification — Enter your email address and verify with a one-time code sent to your inbox.
- Google Sign-In — Authenticate using your Google account.
You are responsible for maintaining the security of your account. You must not share your authentication credentials or allow unauthorized access. You must provide accurate and complete information during registration.
4. HubSpot Portal Connection
After creating an account, you may connect one or more HubSpot portals via OAuth authorization. By connecting a portal, you grant OptiHub permission to:
- Read and write contact, company, and deal records (as required by workflow actions).
- Access workflow automation data to execute custom actions.
- Store encrypted OAuth tokens for maintaining the connection.
You may disconnect your portal at any time from your account settings.
5. Acceptable Use Policy
You agree not to use OptiHub to:
- Violate any applicable laws, regulations, or third-party rights.
- Send malicious webhooks, perform DDoS attacks, or abuse external services.
- Execute code that attempts to access unauthorized systems, files, or resources.
- Store sensitive data (credit card numbers, passwords, health records) as secrets unless properly encrypted.
- Exceed your plan's execution limits through automated or scripted means.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Resell or redistribute access to the Service without prior written consent.
6. Subscription Plans and Billing
OptiHub offers multiple subscription tiers with varying execution limits, features, and pricing. Current plan details are available on our Pricing page.
Pricing is subject to change with 30 days' prior notice. Execution limits reset on the first day of each billing period. Unused executions do not roll over. Payments are processed through our payment gateway partner and are non-refundable except as described in our Refund Policy.
7. Intellectual Property
All intellectual property rights in the Service, including but not limited to software, designs, logos, and documentation, are owned by BlueOshan Technologies. You retain ownership of any code, data, or content you create using the Service (e.g., custom code snippets). You grant us a limited license to process your content solely for the purpose of providing the Service.
8. Data Security
We take data security seriously. All sensitive data, including OAuth tokens and user secrets, is encrypted using AES-256-GCM encryption. Custom code executes in a sandboxed environment with no access to the filesystem, network, or other system resources. For more details, see our Privacy Policy.
9. Service Level
We target 99.9% uptime for the Service. However, we do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by HubSpot, AWS, or other third-party infrastructure providers.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEOSHAN TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Termination
You may terminate your account at any time from your account settings or by contacting us at sales@optihub.in. We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay for a paid subscription. Upon termination, your data will be retained for 30 days and then permanently deleted.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Chennai, India.
